Executive Legal Summary • Iowa Civil Procedure

Iowa Small Claims Court has jurisdiction over civil money claims up to $6,500 (exclusive of interest and costs) as well as Forcible Entry and Detainer (FED) eviction actions under Iowa Code § 631.1. Under Iowa Code § 631.4, a Small Claims Original Notice for a money judgment may be served personally by a process server under Rule 1.305 or by certified mail—giving the defendant 20 days after service to file an Appearance and Answer in EDMS.

1. Iowa Small Claims Jurisdictional Limit ($6,500) & Types of Actions (Iowa Code § 631.1)

Under Iowa Code § 631.1(1), a small claim in Iowa is a civil action for a money judgment where the amount in controversy is $6,500 or less, exclusive of interest and court costs. Small Claims Court also exercises jurisdiction over actions for Forcible Entry and Detainer (evictions under Chapter 648) where no title question is raised, actions for replevin (recovery of specific personal property valued at $6,500 or less), and actions to dispose of abandoned mobile homes or personal property.

Small claims filings in Iowa are mandatory electronic filings through the Iowa Judicial Branch Electronic Document Management System (EDMS), using official Supreme Court Small Claims Original Notice and Petition forms (such as Form 3.1 for money judgment).

2. How to Serve an Iowa Small Claims Original Notice for Money Judgment (Iowa Code § 631.4(1))

Unlike states where a small claims summons sets an immediate trial date, an Iowa Small Claims action for a money judgment operates like a streamlined District Court action: under Iowa Code § 631.4(1)(a) and § 631.5(1), once the defendant is served with the Original Notice, the defendant has 20 calendar days after service (or 60 days for certain out-of-state/statutory agents) to electronically file a written Appearance and Answer on EDMS! Only if the defendant files a timely Answer denying the claim does the clerk schedule a contested small claims trial date.

Under Iowa Code § 631.4(1), the plaintiff may choose to have the Small Claims Original Notice served either:

1. By the clerk via Certified Mail with return receipt requested to each defendant; OR

2. By personal service through a private process server (or sheriff) in accordance with Iowa Rule of Civil Procedure 1.305!

3. Why Personal Service Beats Certified Mail in Iowa Small Claims

When the clerk mails a Small Claims Original Notice by certified mail under Iowa Code § 631.4(1)(a), service is complete ONLY if the certified mail return receipt is signed (or if the defendant expressly 'refuses' delivery from the carrier, allowing regular mail follow-up under Rule 1.306). However, in the vast majority of failed certified mail attempts, the debtor simply ignores the USPS slip left in their mailbox, and 3 weeks later the letter is returned marked 'Unclaimed' or 'Moved, Left No Address.'

Under Iowa law, an 'Unclaimed' certified letter is NOT a refusal and does NOT constitute valid service! When that happens, you have lost nearly a month and still cannot obtain a default judgment.

By hiring our private process servers ($62 Standard across all 99 Iowa counties), we personally deliver the Small Claims Original Notice to the defendant or a co-resident adult aged 18 or older at their dwelling under Iowa R. Civ. P. 1.305(1) (or to a business's registered agent under Rule 1.305(6)). The 20-day default judgment clock starts immediately on the day of delivery.

4. Special Small Claims Rules for Evictions (FED) & Replevin (Iowa Code § 631.4(2))

Note that while a small claims money action uses the 20-day answer procedure, a Forcible Entry and Detainer (FED) eviction filed on the small claims docket is governed by Iowa Code § 631.4(2) and § 648.5: the hearing date is set immediately upon filing, and the Original Notice must be served at least 3 days before the hearing (or 4 days if posted and mailed after two diligent personal attempts fail).

5. Recovering Your $62 Process Server Fee on Default or Trial Judgment

Under Iowa Code § 631.11 and § 625.14, when you file our Return of Service and invoice on Iowa EDMS, the clerk taxes your private process server fee as a recoverable court cost added directly to your small claims money judgment.

6. Enforcing Your Iowa Small Claims Judgment After Service & Default

Once our process server serves the Small Claims Original Notice under Iowa R. Civ. P. 1.305 and files the Return of Service in EDMS, the defendant has 20 calendar days to file an electronic Appearance and Answer. If the defendant fails to answer within 20 days, the clerk or magistrate enters a default judgment for your claim amount plus filing fees and our $62 process server fee (note that in small claims under Chapter 631, the 10-day written notice of intent to file for default under Rule 1.972 is generally not required when the Small Claims Original Notice itself states the 20-day default warning).

After judgment is entered, if the debtor does not voluntarily pay, we can immediately serve an Order for Debtor's Examination under Iowa Code Chapter 630 and a Notice of Garnishment under Iowa Code § 642.14.
