Proof of Service & Return of Service Requirements in Iowa (Rule 1.308 & § 622.1)
Master Iowa's Return of Service rules under Iowa R. Civ. P. 1.308, unsworn certifications under penalty of perjury under Iowa Code § 622.1, and Iowa EDMS e-filing requirements.
Under Iowa Rule of Civil Procedure 1.308(1), Iowa courts take judicial notice of the signatures of sheriffs and deputies, but a Return of Service by a private process server MUST be accompanied by an Affidavit OR an unsworn certification under penalty of perjury pursuant to Iowa Code § 622.1 stating the time, manner, and place of service and the name of the person to whom copy was delivered.
1. Statutory Elements of a Valid Iowa Return of Service (Iowa R. Civ. P. 1.308)
Under Iowa Rule of Civil Procedure 1.308(1), proof of service of an Original Notice is made by filing the Return of Service with the court via the Iowa Electronic Document Management System (EDMS). While the court takes judicial notice of the official signature of an Iowa sheriff or deputy sheriff without an oath, any service made by a private process server must be sworn to by Affidavit or certified under penalty of perjury.
To withstand a motion to dismiss for insufficient service of process or a motion to set aside a default judgment under Iowa R. Civ. P. 1.977, an Iowa Return of Service must explicitly state:
• The exact titles of all documents served (e.g., Original Notice, Petition at Law, Protected Information Disclosure).
• The full name of the party served and, if served by dwelling/abode delivery under Rule 1.305(1) or entity delivery under Rule 1.305(6), the full name of the person to whom the copy was delivered and confirmation that they are at least 18 years old and reside at the dwellinghouse (or hold an authorized corporate/registered agent capacity).
• The exact calendar date, time of day, and complete street address (including city, county, and state) where service was effected.
• Confirmation that the process server is neither a party to the action nor an attorney for a party as required by Rule 1.302(4).
2. Unsworn Certification Under Penalty of Perjury (Iowa Code § 622.1) vs. Notarization
In 2013, the Iowa Legislature enacted Iowa Code § 622.1, which modernized affidavit requirements across all Iowa state courts. Under Iowa Code § 622.1(1), whenever any matter is required or permitted by law or court rule to be supported, evidenced, established, or proved by the sworn written declaration, verification, certificate, statement, oath, or affidavit of a person (other than a deposition, an oath of office, or an oath required to be taken before a specified official other than a notary public), it may with like force and effect be supported by an unsworn written certification signed and dated under penalty of perjury!
Iowa Code § 622.1(2) specifies the exact statutory certification language: 'I certify under penalty of perjury and pursuant to the laws of the state of Iowa that the preceding is true and correct. [Date] [Signature].' Our Returns of Service include both full statutory compliance with Iowa Code § 622.1 and traditional notary public acknowledgment whenever required for out-of-state courts.
3. Filing Returns of Service in Iowa EDMS (Iowa R. Elec. P. 16.314)

4. Mandatory 10-Day Notice of Intent to File for Default (Iowa R. Civ. P. 1.972)
Litigators in Iowa should also remember that after personal service of an Original Notice is perfected and the 20-day answer window expires, Iowa R. Civ. P. 1.972(2)-(3) requires mailing a 10-day written Notice of Intent to File Written Application for Default to the defaulting party's last known address (and to any known counsel) before the clerk or judge can enter a default judgment.
5. Amending a Return of Service Under Iowa R. Civ. P. 1.309
Under Iowa R. Civ. P. 1.309, the court may allow any process or proof of service thereof to be amended at any time and upon such terms as it deems just, unless it clearly appears that material prejudice would result to the substantial rights of the party against whom the process issued.

Frequently Asked Questions
Does an Iowa Return of Service by a private process server have to be notarized, or is an Iowa Code § 622.1 certification valid?
Under Iowa Code § 622.1, an unsworn written certification signed and dated under penalty of perjury carries the exact same legal force and effect as a notarized affidavit in all Iowa state courts. We also provide traditional notarized affidavits whenever requested.
Does failure to file the Return of Service immediately invalidate the service itself in Iowa?
Under Iowa R. Civ. P. 1.308(4), failure to make proof of service does not affect the validity of the service itself, though the Return of Service must be filed in EDMS before the court can enter default judgment or conduct an eviction hearing.
